State law says "An individual licensee may not pay a finder's fee or give any valuable consideration to an unlicensed person or entity for referring a prospect, except that a licensee may give a gift valued at $250 or less to an individual in appreciation for an unsolicited referral of a prospect that results in a real estate transaction. R162-2f-401b(12)(a)
The key to this law is the word "Unsolicited." You are allowed to provide a gift up to $250 if you didn't solicit for that referral. For instance, you can't say "for every referral I receive you will receive a gift card for $250."
If the referral comes from an active licensed real estate agent then the referral amount would be determined and agreed upon between the referring and receiving brokers and is not limited to $250.
