Various documents ask for the “Signature of Authorized Agent or Broker.” So when is an agent an authorized agent? In short, if it ever says authorized agent you are allowed to sign the document as long as your license is still current at KW South Valley Keller Williams.

Some of those forms include:

  • Limited Agency Consent Agreement. You may sign this even if you only represent one of the parties. In fact, I'd prefer you to sign these documents as they need to be signed prior to presenting the offer.
  • Cancellation and Termination of the Exclusive Buyer-Broker Agreement & Agency Disclosure: Yes
  • Cancellation and Termination of the Exclusive Right to Sell Listing Agreement & Agency Disclosure: Yes

Scenario: I just transferred brokerages. May I have my client cancel their contract with the old brokerage and have them resign with the new brokerage?

NO, this is not permitted. Once you have left the brokerage you are no longer an authorized agent as you are no longer licensed with that broker and are licensed somewhere else. Contracts in Utah stay with the broker unless agreed upon by all parties. You independent contractor agreement states how you will be paid.
